1. Acceptance of Terms
By creating an account, accessing, or using the Services, you represent that you are legally capable of entering into a binding agreement and agree to comply with these Terms and all applicable laws and regulations.
2. Description of Service
Hausly provides a digital platform designed to help households organize schedules, documents, tasks, communications, and related family information. We may modify, suspend, or discontinue all or part of the Services at any time, with or without notice, to the extent permitted by law.
3. User Accounts and Responsibilities
You may need to create an account to access certain features of the Services. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activities that occur under your account and for ensuring that your use of the Services complies with these Terms.
4. Acceptable Use Policy
You agree not to use the Services to violate any applicable law or regulation; harass, threaten, abuse, or harm any person; attempt to gain unauthorized access to the Services, accounts, systems, or networks; interfere with or disrupt the integrity or performance of the Services; or use the Services to transmit malicious code, spam, or other harmful material.
5. Content Ownership
You retain ownership of the content, information, files, documents, images, messages, and other materials you upload, submit, or store through the Services. You grant Hausly a limited, non-exclusive, worldwide license to host, store, reproduce, process, and display User Content solely as necessary to operate, provide, maintain, and improve the Services for you and your household.
6. Subscription and Billing
Certain features of the Services may be offered on a paid subscription basis, if applicable. If you purchase a subscription, you agree to pay all applicable fees and taxes and authorize us or our payment processors to charge your selected payment method. Subscription fees may recur unless canceled in accordance with the terms presented at the time of purchase. We may change pricing or billing terms upon reasonable notice to the extent permitted by law.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, HAUSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HAUSLY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES. TO THE FULLEST EXTENT PERMITTED BY LAW, HAUSLY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO HAUSLY FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR FIFTY U.S. DOLLARS ($50).
9. Indemnification
You agree to defend, indemnify, and hold harmless Hausly, its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your User Content, your misuse of the Services, or your violation of these Terms or applicable law.
10. Governing Law
These Terms and any dispute arising out of or relating to these Terms or the Services shall be governed by the laws of the State of North Carolina, USA, without regard to its conflict of law principles.
11. Dispute Resolution
To the fullest extent permitted by law, you and Hausly agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. You and Hausly also waive any right to participate in a class action, class arbitration, or representative proceeding.
12. Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms or if necessary to protect the Services, users, or our rights. You may stop using the Services at any time and may request account deletion in accordance with our applicable policies.
